Terms of Service
These Terms of Service govern the provision, operation, and usage of virtual cloud servers, game servers, and network infrastructure provided by Swap Hosting.
1. General Agreement & Scope of Services
By creating an account, ordering a service, or accessing any infrastructure provided by Swap Hosting (“Provider”, “we”, “us”), you (“Client”, “User”) agree to be bound by these Terms of Service.
Swap Hosting provides enterprise game servers, dedicated high-frequency compute instances, and virtual private servers (VPS/VDS) hosted across European Tier-III/IV datacenter facilities located in Frankfurt (Germany), Amsterdam (Netherlands), Stockholm (Sweden), and Helsinki (Finland).
Services are provided on an “as is” and “as available” basis. The Provider reserves the right to modify service technical parameters, tariff specifications, or operational procedures to maintain network stability and infrastructure integrity.
2. Account Security & Credentials
To access and manage services, clients must maintain an active account with a valid email address and secure credentials.
The Client is solely responsible for preserving the confidentiality of account login credentials, root/administrator server passwords, API access keys, and SSH keypairs. All operations, resource deployments, and traffic originating from an authenticated account are legally presumed to have been authorized by the Client.
In the event of suspected unauthorized account access, the Client must immediately update their credentials and notify our support desk.
3. Hardware Allocation & Compute Performance
Swap Hosting operates a dedicated resource architecture without overselling physical compute threads. Server instances are backed by AMD Ryzen 9 7950X3D (up to 5.7 GHz) and AMD EPYC enterprise processors.
- Memory: High-frequency DDR5 and DDR4 ECC Registered RAM allocated exclusively to the virtual partition.
- Storage: Enterprise NVMe SSD storage in RAID arrays delivering high I/O throughput and low-latency disk operations.
- Automated Deployment: Following successful order confirmation, instances are automatically provisioned and accessible via the control panel within minutes.
4. Network Connectivity & Fair Use Traffic Policy
All instances benefit from high-capacity uplinks (up to 1 Gbps / 10 Gbps) connected to primary European internet exchange points and tier-1 transit carriers.
To maintain consistent throughput and prevent network congestion for all users, a fair-use policy applies to network bandwidth. If a virtual instance generates sustained abnormal outbound traffic exceeding reasonable consumption thresholds or indicative of continuous bulk proxy relaying, the Provider reserves the right to apply temporary bandwidth shaping (down to 10 Mbps or 100 Mbps) for the remainder of the active billing cycle.
Included automated DDoS protection filters layer-3 and layer-4 volumetric attacks at the edge to ensure service continuity.
5. Acceptable Use Policy (AUP) & Forbidden Activities
In compliance with European cybersecurity regulations and hosting industry standards, the following activities are strictly prohibited across all Swap Hosting infrastructure:
- Network Abuse: Launching, relaying, or testing Denial-of-Service (DoS/DDoS) attacks, UDP/SYN floods, botnet command centers, or unauthorized network port scanning.
- Cryptocurrency Mining: Running proof-of-work mining software (e.g., Monero, XMRig, Bitcoin) on virtual instances or shared resources.
- Malicious Code: Hosting or distributing ransomware, trojans, exploit kits, rootkits, or credential harvesting phishing pages.
- Unsolicited Traffic & Spam: Operating open mail relays, bulk email spam engines, or automated credential-stuffing tools.
- Illegal Content: Hosting child exploitation material, terrorist propaganda, unlicensed copyrighted streams, or any content violating applicable laws.
Any service found engaging in prohibited activities will be suspended immediately without advance notice and without entitlement to refunds.
6. Data Backups & Storage Sanitization
While the Provider maintains hardware redundancy and RAID array protection, the Client holds sole and ultimate responsibility for creating and maintaining independent, off-site backups of critical server databases, configurations, and game files.
Upon voluntary service cancellation or account termination resulting from non-payment, server storage partitions are decommissioned and undergo a secure cryptographic wipe procedure to guarantee that no residual client data remains on physical hardware.
7. Billing Cycles, Renewals & Refunds
Services are provided on a prepaid recurring basis (monthly, 3-month, 6-month, or annual terms). Renewal invoices are issued prior to expiration.
Suspension & Deletion: If a service is not renewed by its expiration date, it enters a temporary suspension grace period. Unpaid services that remain past the grace period are permanently deleted along with all associated storage.
Refunds: First-time orders may request a refund within 24 hours of provisioning if the server suffers from verified hardware failure that cannot be rectified by support. Suspended services that violated the Acceptable Use Policy, custom setup fees, and cryptocurrency payments are non-refundable.
8. Limitation of Liability & Governing Law
Swap Hosting is not liable for indirect, incidental, or consequential damages resulting from downtime, hardware defects, upstream connectivity disruptions, or incompatibility with third-party software installed by the Client. The Provider's total aggregate liability shall not exceed the amount paid by the Client for the affected service during the current billing month.
These Terms of Service are governed by and construed in accordance with the laws of the European Union. Any legal disputes shall be submitted to the exclusive jurisdiction of European courts.
